Start with the exact certificate, issue date or anniversary control, and the current DEC38 form downloaded from WORC. Then build a narrow declaration file showing the holder's identity, the Caymanian spouse or civil partner's identity and continuing right, relationship-status changes, employment and income, children and dependants, absence, conviction and health answers, CI$100 proof of payment, submission proof, and the signed retained copy. Do not repurpose a spouse application checklist or a different annual declaration form for this route.

The current DEC38 form is marked WORC/DEC38 (2026/06). It directs the holder to send the completed declaration and proof of CI$100 payment to AnnualDeclarationSubmissions@gov.ky and to keep a copy. The form does not state a payment method, postal route, in-person route, main-form witness block, or a precise calendar deadline. Calendar the filing from the exact certificate, the MCEI/WORC annual-declaration instructions, and any written advice rather than calculating a universal date.

Declarant and Caymanian spouse or civil-partner identity reconciliation
DEC38 collects identity and contact details for both the permanent resident and the Caymanian spouse or civil partner. Reconcile passports, date of birth, gender, address, telephone, email, legal names, and the Caymanian spouse or partner's continuing right before signing. Keep name-change and address-change records close to the declaration so the file explains why current documents differ from the original RERC or last declaration.
- Compare the passport and contact details on DEC38 with the original certificate, current passport, employer records, lease or household records, and any prior annual declaration.
- Preserve certified civil records or legal-name documents where a marriage, civil partnership, divorce, dissolution, deed, passport renewal, or spelling correction changed the name trail.
- Confirm the Caymanian spouse or civil partner's current right or status evidence before answering the continuing-right question.
- If either person now lives separately or uses a different mailing address, explain the practical and legal position before the record appears inconsistent.
- Keep identity and status evidence privacy-controlled and label any copy supplied by document owner, date, issuer, and purpose.
Continuing Caymanian right and relationship-status change control
The current form asks whether the spouse or civil partner continues to hold the right to be Caymanian and whether the relationship status has changed. If the relationship status changed, DEC38 requires a signed affidavit addressing breakdown, separation, divorce or dissolution and the date the circumstances changed. Treat this as a legal-risk lane, not as an optional personal update.

Caymanian-child support, involvement, and new-child records
DEC38 asks about financial and positive involvement in the life of a Caymanian child and about children born or adopted since the grant or last annual declaration. Organize child records proportionately. A spouse/civil-partner DEC38 filing is not the same as a parent-of-Caymanian-child continuation declaration, and new-child facts may raise separate family, status, dependant, or continuation advice questions.

DEC38 asks about accompanying and non-accompanying dependants, changes to accompanying dependants, and school or tertiary-education details for relevant dependants. The form directs holders to the relevant variation application if the number of accompanying dependants changed. Keep the dependant evidence lane separate from the annual declaration so the declaration does not become an unsupported variation request.

Absence, conviction, and health-disclosure controls
The form asks about absence from Cayman for one year or more, convictions since grant, and the current mental-health question stated in the form. These are sensitive disclosures. Prepare dated evidence and advice before filing where the answer is unclear, historic, foreign, private, or potentially contested. Do not minimize a fact because it is embarrassing or because the holder stayed in contact with family while away.
- For absence, keep departure and return dates, location, reason, employment or caregiving context, relationship and child-contact records, and advice on residence implications.
- For conviction or character issues, keep country, date, offence description, sentence or result, court record, police record, pending-status note, and disclosure advice.
- For health disclosures, keep the minimum necessary clinical record, treating professional, current treatment or support position, and advice on the exact form wording.
- If a sensitive answer changed since the last declaration, preserve the earlier declaration, event date, updated evidence, advice note, and final answer.
- Do not let a family member, employer, school, or landlord edit sensitive answers for convenience.
No-blanks, correction, signature, and retained-copy control
DEC38 instructs the holder not to leave blanks, to use NOT APPLICABLE or N/A where appropriate, to use a separate sheet if necessary, and not to use correction fluid or tape. It says to cross out and initial an error or complete a fresh page. The permanent resident must sign; agency signature is not acceptable. The main declaration has no witness, justice-of-the-peace, or notary block.

False-statement, missed-filing, revocation, and professional-review guardrails
DEC38 warns that materially false statements can be an offence and states that false information or failure to submit annually can be grounds for revocation of the relevant certificate. That warning is serious, but it does not let this guide decide that one late, incomplete, corrected, or disputed filing automatically causes revocation. Use current WORC instructions and qualified Cayman immigration advice where the file involves relationship breakdown, spouse-status uncertainty, dependant variation, work-scope uncertainty, long absence, conviction, health disclosure, missed filing, or possible revocation.
