The public R38 is internally marked 2026/05 and contains useful current fields and checklists, but its duration language is not internally consistent. Record the conflict rather than choosing the more convenient sentence. Confirm the applicable duration, route, fee, submission method, continuation rules, work scope, dependant requirements, and declaration obligations against current legislation and live WORC instructions before signing or paying.

R38 asks for a joint account of how the applicant and Caymanian spouse or civil partner met. Build that account from dated records rather than memory alone. It should be factual, consistent with passports, travel, addresses, prior relationships, marriage or civil-partnership records, children, employment, and any earlier immigration applications. The aim is an accurate chronology, not a theatrical narrative.
- Create a dated timeline covering first contact, in-person meetings, periods apart, visits, engagement or decision to formalize the relationship, marriage or civil partnership, moves, shared addresses, children, and material changes.
- Retain a bounded sample of primary records that supports the chronology without sending an uncontrolled archive of private messages, photographs, financial data, or third-party information.
- Explain long-distance periods, separate residences, work rotations, caregiving, study, travel restrictions, or other facts that could otherwise appear inconsistent.
- Match names, dates, locations, and prior-relationship information across the cover letter, certificates, passports, affidavits, references, and form answers.
- Have both parties review the final chronology and identify any fact that requires supporting evidence or legal advice before signing.
Marriage, civil-partnership, and prior-relationship evidence
The current form asks for certified relationship records and disclosure of prior marriages, civil partnerships, widowhood, dissolutions, and related dates for both parties. Build a clean civil-status chain. Do not assume a foreign certificate, divorce record, death certificate, translation, or name change will be accepted in the form in which it is currently held.

Applicant and Caymanian spouse identity, status, and work records
R38 collects passport, nationality, birth, contact, address, occupation, employer, and employment information for the applicant and the Caymanian spouse or civil partner. The checklist also calls for proof that the spouse or partner is Caymanian and employment letters for both parties, or an explanation of unemployment. Keep identity, Caymanian-status, employer, payroll, address, and immigration records aligned.
- Retain certified passport bio-data pages, birth records, current contact details, residential addresses, and a legal-name variation schedule for both parties.
- Obtain the current WORC instruction for acceptable proof that the spouse or civil partner is Caymanian; do not infer the required document from an older application.
- Ask each employer letter to use the current checklist fields and to match the actual employer, position, length of employment, remuneration record, and work location.

The public checklist calls for a joint affidavit before a Justice of the Peace or Notary Public, written references with identity evidence and handling requirements, applicant photographs, and a complete form with no unanswered fields. These are procedural evidence controls, not substitutes for the underlying relationship and identity file.

Confirm the exact document window and issuer requirements at filing because a form can change. Treat police, health, financial, and company records as sensitive and send them only through the confirmed route.
- List every jurisdiction that may require police evidence, the accepted issuing authority, document date, original or sealed requirement, translation status, and delivery method.
- Use the current WORC medical materials and confirm accepted doctor, test, signature, cover-letter, and timing requirements before arranging examinations.
- Prepare complete explanations and primary records for any arrest, charge, conviction, sanction, bankruptcy, failed company, unpaid creditor, earlier RERC, cancellation, or adverse immigration history identified by the form.
- Do not omit a matter because it seems minor or old; obtain advice on the exact disclosure question and provide an accurate answer.
- Maintain an encrypted or access-controlled working file and a submission log showing what was sent, by whom, when, and through which channel.
Children, dependants, custody, support, and accommodation
Non-Caymanian dependants require a separate RAD supplement where applicable. That form reaches beyond birth certificates: it asks about relationship, residence, guardian, character, health, insurance, accommodation, household occupancy, finances, legal support, custody, and in specified cases DNA evidence. A Caymanian-child continuation route is a different legal and evidence question from adding a dependant to an initial spouse application.

Employment rights, occupation, and change control
The certificate's name includes employment rights, and R38 asks for occupation and employer details, but the practical scope of work authority, employer or occupation changes, self-employment, side work, unemployment, reissue, and notification duties should be confirmed for the exact certificate and stage. Do not start, change, or continue work based only on an application receipt or the page title of a form.
- Record the applicant's current work permission, employer, occupation, location, start date, compensation, and any condition printed on an existing permit or certificate.
- Ask in writing what work the requested certificate would authorize and whether a new employer, occupation, business, side activity, or period of unemployment requires notification, variation, reissue, or another approval.
- Keep employer, payroll, pension, health-insurance, tax-reporting, company, and immigration records consistent when employment changes.
- Do not let an employer set a start date that depends on an unissued or unverified permission.
- Build an event log for job changes, address changes, relationship events, births, dependant changes, passport renewals, legal-name changes, and overseas absences.
Genuine-relationship review and arrangements-of-convenience boundary
Current reform materials allow decision-makers to consider whether there are reasonable grounds to suspect an arrangement of convenience rather than a genuine relationship. That is a legal and evidence assessment for the authority, not a label for relatives, employers, advisers, or this website to apply. Prepare truthful records, preserve context, and get advice if the file contains inconsistencies, prior refusals, unusual chronology, third-party allegations, separate residences, or other facts likely to require explanation.
- Do not manufacture joint bills, staged photographs, scripted references, backdated records, or a simplified story that hides material facts.
- Separate ordinary practical complexity from legal conclusions: work travel, caring responsibilities, housing shortages, finances, or cultural arrangements may require explanation but should not be self-classified.
- If WORC requests an interview, additional documents, or information from third parties, preserve the request, deadline, response owner, evidence supplied, and advice received.
- Correct an error transparently and promptly through the advised route rather than silently changing later versions of the file.
- Keep third-party personal data proportionate and obtain advice before disclosing private communications or records belonging to children or other adults.
Submission, acknowledgment, annual declarations, and relationship events
Current reform guidance states that spouse or civil-partner RERC holders are within the annual-declaration framework. The exact filing date, form, particulars, fee, and consequences should be confirmed against current official materials. Death, divorce, dissolution, annulment, a Caymanian-child continuation request, employment change, and other material events can create separate and urgent advice needs; do not manage them as an ordinary annual update.
