Build the South African departure and Cayman arrival files together
Your travel date, tax-residence position, employment change, property decision, money-transfer approval, police certificate, Cayman work-permit milestone, insurance start, and family arrival can all happen on different dates. Put both countries into one dated control file before resigning, selling assets, moving money, shipping goods, or relying on a Cayman start date.
- Record intended and actual travel days, employment, accommodation, family location, South African property and business interests, income sources, and the Cayman immigration route.
- Keep passports, contracts, SARS returns and notices, RAV01 evidence, bank and investment statements, asset records, insurance, school files, and travel confirmations together.
- Assign an owner and deadline to every SARS, bank, Authorised Dealer, employer, fund, insurer, school, property, police-record, and Cayman handoff.
- Use written professional advice for residence, tax, retirement, exchange-control, immigration, employment, and regulated financial decisions.
Test South African tax residence from facts, not the boarding pass
SARS describes ordinary residence, the physical-presence test, and an applicable double-tax agreement as separate parts of the residence analysis. A Cayman address or permit does not automatically end South African tax residence. A person who was resident only under the physical-presence test may be deemed to have ceased residence from departure after being outside South Africa for a continuous period of at least 330 full days, but that rule is not a universal answer.
- Keep the departure year and the first full Cayman year as separate evidence periods.
- Preserve proof of South African and Cayman accommodation, work, family location, travel, and continuing connections.
- Do not describe the move as automatically ending residence, filing, payment, or disclosure obligations.
| Residence question | Evidence to assemble | Checkpoint |
|---|---|---|
| Ordinarily resident | Homes, family, employment, business, personal belongings, social ties, return pattern, long-term plans, visas, and written advice. | Ask an adviser to document whether South Africa remains the place to which you would naturally and as a matter of course return. |
| Physical presence | A complete day-by-day calendar for the current and preceding years, supported by passports and travel records. | Check every limb of the test and whether the continuous 330-full-day rule is relevant; do not apply it by slogan. |
| Treaty position | Residence facts in both jurisdictions, income and asset map, accommodation, and any professional treaty analysis. | Confirm whether a treaty is relevant and what evidence SARS expects; do not assume Cayman changes the answer by itself. |
Update SARS records and preserve the residence-status case
SARS currently directs individuals who cease residence to update the Income Tax Liability Details section of the RAV01 registration record through eFiling. That action creates a case and supporting-document request. The evidence can include a signed declaration, motivation, travel diary, passport, foreign visa or residence evidence, and facts about property, business, family, social ties, return visits, and the intended date of cessation.
- Reconcile the date entered on RAV01 with the travel calendar, return disclosures, employment changes, property file, and adviser memo before submission.
- Download prior returns, assessments, statements of account, notices, tax directives, correspondence, and registration details while eFiling access is stable.
- Track every SARS request, upload, acknowledgement, case number, decision, objection or correction, and adviser instruction in the control file.
- A profile update is not itself a guaranteed residence conclusion; SARS and the relevant law determine the outcome from the facts.
Review the deemed-disposal and South African-source income file
SARS says ceasing South African tax residence can trigger a deemed disposal of certain worldwide assets at market value, with exclusions that include South African immovable property. After cessation, non-residents can remain taxable on South African-source income and specified gains. The asset perimeter, valuation date, base cost, exclusions, losses, ownership, and return treatment need adviser-led review; this guide does not calculate a deemed-disposal amount.
| File | Questions to close | Evidence to retain |
|---|---|---|
| Investments and business interests | Ownership, market value, base cost, exclusions, foreign currency, vesting, trust or company interests, and reporting date. | Statements, contracts, valuations, cap tables, tax records, advice, and calculation support. |
| South African property | Keep, rent, or sell; mortgage and insurance terms; rental tax; agent authority; future disposal; and source-of-funds trail. | Title and cost records, valuations, lease or sale documents, statements, invoices, and correspondence. |
| Continuing South African income | Source, withholding, return, payment, provisional-tax, pension, interest, rental, service, or business treatment after departure. | Contracts, tax certificates, invoices, receipts, payment trail, returns, assessments, and adviser memo. |
Use current AIT and Tax Compliance Status terminology
The current SARS process is Approval International Transfer, or AIT, within the Tax Compliance Status functionality. Older references to financial emigration or foreign-investment-allowance procedures should not be used as the current procedural label. Individuals can request a TCS for AIT through eFiling, supply supporting documents, and use the resulting PIN for authorised third-party verification when appropriate. Approval should never be assumed.
- Ask the South African bank or Authorised Dealer which current transfer path, SARS status, forms, documents, and transaction references apply before moving funds.
- Keep the TCS request, PIN controls, supporting-document index, SARS correspondence, bank instructions, quotes, confirmations, and settlement record together.
- Do not hard-code a universal transfer limit, allowance, approval time, or bank process; current rules and the customer's facts determine the route.
- Make sure tax-residence, source-of-funds, asset, and account information tells one consistent story across SARS, the bank, and Cayman onboarding.
Build the source-of-funds and international-transfer evidence pack
SARS asks for supporting evidence matched to the source of the money and, for AIT requests, information about assets and liabilities across prior tax years. The appropriate file differs for savings, salary, a property sale, inheritance, trust distribution, donation, loan, shares, business proceeds, or digital assets. Your Authorised Dealer and receiving Cayman institution can also ask for their own evidence.
- Prepare certified copies only after the receiving party confirms the certifier, wording, date, format, and delivery method.
- Keep the rand conversion, fees, spread, intermediary charges, receiving amount, and purpose-of-payment record for each transfer.
- Use the Cayman source-of-funds checklist before a lease, school payment, property purchase, or bank deadline depends on the transfer.
| Source | Core evidence | Reconciliation control |
|---|---|---|
| Savings or salary | Payslips, employment contract, tax certificates, returns, assessments, bank statements, and accumulation history. | Trace the opening balance, deposits, taxes, transfers, and closing balance without unexplained jumps. |
| Property, shares, or business proceeds | Ownership and cost records, valuations, contracts, settlement statements, taxes, statements, and receipt into the account. | Match the asset, seller, dates, gross price, costs, net proceeds, and onward transfer. |
| Inheritance, trust, donation, or loan | Estate, trust, donor, or lender authority; agreements or resolutions; tax treatment; bank trail; and relationship evidence. | Confirm legal capacity, beneficial owner, purpose, repayment or distribution terms, and recipient requirements. |
Keep retained accounts, property, investments, and policies operational
Moving does not automatically close South African assets or obligations. Banks, investment platforms, insurers, medical schemes, lenders, companies, trusts, property managers, and retirement funds can each have overseas-address, tax-self-certification, product-eligibility, authentication, payment, and reporting requirements.
- Inventory every account, card, loan, debit order, investment, policy, property, company, trust, pension or retirement fund, subscription, and recurring tax payment.
- Ask each provider what changes when the holder is non-resident or overseas, and obtain the answer in writing before closing or transferring anything.
- Keep at least one tested payment route until Cayman banking, salary, cards, and emergency cash are stable.
- Do not use a stale South African address or inaccurate tax-residence self-certification to preserve access.
Order the SAPS police certificate against the recipient's checklist
The South African Police Service issues police clearance certificates through its Criminal Record Centre. Applicants generally need a full set of fingerprints plus identity evidence, and people abroad can arrange fingerprints through an appropriate local police service or South African mission. The Cayman recipient controls the useful recency, format, legalisation, translation, and delivery requirements, so confirm those before applying.
- Do not rely on an old fee or processing-time estimate; verify the current SAPS instructions and the recipient deadline.
- A police certificate is not a guarantee of a Cayman immigration, employment, or other outcome.
| Control | Verify before applying | Evidence to retain |
|---|---|---|
| Identity and fingerprints | Accepted fingerprint form, name and maiden-name history, identity document or passport copy, photo, and submission method. | Application copy, fingerprint receipt, courier record, identity copy, and payment evidence if required. |
| Recipient requirements | Purpose, issue-date window, original or digital format, apostille or legalisation, translation, and delivery destination. | Written Cayman checklist, certificate scan, original-custody log, and legalisation records. |
| Timing | Current SAPS service status, delivery route, tracking method, and contingency if the useful window closes. | Reference number, status checks, correspondence, delivery proof, and replacement plan. |
Keep voting, passport, and consular continuity realistic
The Electoral Commission says registered South African voters abroad can vote only in national elections and must follow the current overseas-voting process, including any election-specific VEC 10 timetable. Passport and civic-document services are controlled by Home Affairs and the responsible South African mission. Confirm through DIRCO which mission covers the Cayman Islands rather than assuming the nearest listed post has accreditation.
- Check voter registration, ID, accredited voting station, notice deadline, and election-day requirements from the current Electoral Commission instructions.
- Review passport validity before immigration, school, banking, or travel deadlines and allow for overseas processing through the responsible mission.
- Save current DIRCO and mission contacts offline, along with separate colour scans and identifiers for passports and civil records.
- Treat an emergency travel document as an emergency route with limits, not a substitute for routine passport renewal or onward travel planning.
Protect eFiling, banking, phone, and identity access
A compliant move can still fail operationally if eFiling, bank, retirement, insurance, investment, or identity access depends on a South African SIM, device, branch visit, postal address, card, or one-time password that no longer works. Test the overseas path before departure and preserve a lawful recovery route.
| Access item | Test before departure | Fallback |
|---|---|---|
| SARS eFiling | Login, security contacts, RAV01 access, returns, notices, uploads, payments, representative access, and document downloads. | Recovery details, tax-practitioner authority, secure exports, and SARS support route. |
| Phone and identity | Roaming, SIM retention, number-recycling rules, device replacement, email recovery, and Home Affairs or mission requirements. | A tested second factor and recovery information stored separately from the primary device. |
| Banks and providers | Overseas-address policy, cards, app authentication, transfer approvals, product eligibility, tax forms, and international support. | A second payment rail and written recovery steps until Cayman accounts are fully operational. |
Lock the Cayman work and immigration path before irreversible spend
For most employment-led moves, the employer and the current Workforce Opportunities & Residency Cayman process control the work-permit file. A job offer, application, approval, permission to work, dependant position, and proposed start date are different milestones. Do not resign, ship everything, sign an inflexible lease, or pay non-refundable school costs against the wrong milestone.
- Ask the employer or immigration professional for the current document list, submission owner, status-update route, proposed start-date logic, and dependant plan in writing.
- Check passport validity, SAPS and medical evidence, qualifications, references, employment terms, civil records, and dependant documents against the route actually being used.
- Coordinate permit, contract, probation, relocation support, insurance, pension, payroll, housing, school, and arrival dates in one timeline.
- Keep a contingency for delayed approval, police records, housing, insurance, school admission, or a family member arriving later.
Replace South African health assumptions with Cayman evidence
The Cayman Health Insurance Commission explains employer and employee responsibilities for local health insurance. Confirm the insurer, exact effective date, dependant enrolment, premiums, exclusions, network, pre-authorisation, prescriptions, emergency care, overseas care, and complaints route in writing. Do not assume a South African medical scheme, travel policy, or planned employer policy fills every Cayman gap.
| Health handoff | Questions to ask | Documents to carry |
|---|---|---|
| Cayman cover | Effective date, employer contribution, employee and dependant premiums, exclusions, network, emergency and overseas-care terms. | Policy schedule, membership evidence, contacts, claims instructions, and payment confirmation. |
| Clinical continuity | Which GP, specialist, dental, optical, vaccination, imaging, and follow-up work should be completed or booked. | Clinical summaries, imaging, lab results, immunisation records, referrals, and operative reports. |
| Medication | Generic and brand names, lawful import quantity, storage, refills, Cayman prescriber needs, and pharmacy availability. | Prescription, doctor letter where appropriate, medicine list, allergies, and original labelled packaging. |
Sequence banking, housing, schools, shipping, and customs
The expensive mistakes usually happen when arrival tasks are treated as independent. Cayman bank onboarding, South African transfer evidence, rental deposits, school seats, insurance, freight, customs, and temporary accommodation should be sequenced against immigration and payroll gates, with flexible commitments where uncertainty remains.
| Workstream | Before commitment | Evidence to retain |
|---|---|---|
| Banking and foreign exchange | Identity, address, employment, tax residence, source of funds, bank reference, AIT or dealer requirements, fees, spread, and settlement time. | Statements, tax records, source trail, quotes, approvals, confirmations, and purpose-of-payment evidence. |
| Housing and schools | Commute, storm exposure, lease break, permit dependency, school seat, curriculum, assessment, fees, deposits, and refund terms. | Viewing notes, lease, condition report, offer, fee schedule, school reports, references, and health records. |
| Shipping and customs | Inventory, restricted goods, insurance, door-to-door scope, port and storage costs, timing, import documents, and backup essentials. | Quotes, inventory, photographs, declarations, receipts, policy, tracking, and delivery exceptions. |
Run the first 90 days through evidence gates
Keep flexible bookings and a cash buffer until the immigration, insurance, housing, school, banking, transfer, shipment, and South African closure milestones are real. Reconcile both countries after arrival rather than assuming the departure file ended at the airport.
| Gate | South Africa control | Cayman control |
|---|---|---|
| Before irreversible spend | Residence memo, asset map, RAV01 plan, transfer path, employer and fund handoffs, police-record requirements, and access test. | Written immigration milestone, contract, insurance plan, budget, housing and school contingencies, and freight scope. |
| Final two weeks | Travel calendar, payroll, records export, bank and SIM access, documents, recurring payments, courier tracking, and local contacts. | Arrival accommodation, airport transport, payment backup, employer handoff, phone plan, essentials, and emergency contacts. |
| First month | Confirm SARS, bank, fund, benefit, property, insurer, adviser, and document actions were received and remain accessible. | Complete employer, immigration, insurance, bank, phone, transport, housing, school, healthcare, utilities, and emergency setup. |
| Days 31–90 | Reconcile returns, assessments, payments, retained income, transfer evidence, asset records, directives, and unresolved notices. | Reconcile actual costs, payroll, pension, insurance, permits, dependants, licences, renewals, and source-of-funds records. |
Know where professional advice is essential
This page is a planning guide, not a tax-residence determination, deemed-disposal calculation, SARS or AIT approval, exchange-control instruction, retirement-fund or social-grant decision, immigration outcome, financial recommendation, or recipient-specific legal-document checklist. Use the official sources below to frame the file, then have the relevant South African and Cayman professionals confirm the result in writing.
- South African cross-border tax: residence, cessation date, deemed disposal, returns, provisional tax, South African-source income, property, investments, trusts, companies, pensions, and estates.
- Transfers and regulated advice: AIT, Tax Compliance Status, Authorised Dealer process, source of funds, retirement funds, banking, investments, insurance, and currency execution.
- Cayman immigration and employment: route, permission to work, dependants, medical and police evidence, start date, job changes, and renewals.
- Property and family matters: sale or lease contracts, school commitments, custody or consent records, wills, powers of attorney, and cross-border documents.
