Build the Spanish departure and Cayman arrival files together
Your final working day, Spanish tax-residence evidence, census update, Social Security record, police certificate, apostille, bank reclassification, Cayman work-permit milestone, insurance start, shipment, and family arrival can all fall on different dates. Put both jurisdictions into one control file before cancelling access or making non-refundable commitments.
- Record each traveller's citizenship, Spanish residence and employment status, NIF or NIE, Social Security number, passport, health and pension position, bank access, dependants, route, and Cayman immigration lane.
- Keep contracts, payroll, tax and census evidence, Social Security reports, police and civil records, apostilles and translations, banking, housing, school, medical, shipping, and travel evidence together.
- Assign an owner and deadline to every employer, adviser, AEAT office, Social Security contact, registry, apostille authority, translator, bank, consulate, landlord, school, shipper, CBC, WORC, and insurer handoff.
- Use written professional advice where tax residence, retained Spanish income or entities, pensions, custody, immigration, or regulated financial decisions are involved.
Classify the Spanish file before using a checklist
A Spanish citizen, foreign national resident in Spain, employee, autónomo, company director, landlord, retiree, student, and dependant can have different departure controls. Citizenship, Spanish tax residence, census status, Social Security position, bank eligibility, and Cayman immigration are separate questions.
| Lane | Primary controls | Do not assume |
|---|---|---|
| Employee | Employment close, final payroll and records, tax and census file, Social Security history, police and civil documents, banking, and Cayman permission. | A resignation, final payslip, or Cayman offer closes every Spanish or Cayman issue. |
| Autónomo, founder, director, shareholder, or landlord | Personal move plus each registration, entity, property, filing, tax, account, authority, management, and beneficial-owner file. | A personal address change automatically closes an activity or company or ends Spanish-source obligations. |
| Pensioner or benefit recipient | Residence and bank updates, payment and tax position, annual proof-of-life control where applicable, health transition, and Cayman status. | Every Spanish payment continues abroad on the same terms. |
| Foreign national leaving Spain or family member | Spanish residence and employment close, passport-country and prior-residence records, civil and police documents, and a separate Cayman route for each traveller. | Spanish records replace passport-country files or the principal worker's application automatically covers the family. |
Use Spain's visa-free visitor status as one gate only
Cayman Customs & Border Control currently places Spain in the visa-not-required column for visitors. That removes the ordinary Cayman visitor-visa application for a Spanish passport holder under the live list; it does not guarantee airline boarding or landing, authorise work, settle transit rules, or replace a work permit or dependant approval.
- Recheck CBC and the airline close to travel because nationality, residence, route, transit point, document validity, and purpose can change the evidence required.
- Do not buy an inflexible ticket until the transit, work-permit or dependant milestone, landing plan, insurance, and family sequence have been checked for the actual travellers.
| Gate | Evidence to obtain | What it does not prove |
|---|---|---|
| Passport and route | CBC's live country list, a passport valid beyond the return journey, transit-country requirements, ticket, accommodation, funds, and purpose evidence. | Guaranteed boarding, landing, length of stay, or permission to work. |
| Work-permit or dependant route | Employer, application type, current forms, evidence, fees, medical and police requirements, and written status for each traveller. | That a submitted, acknowledged, or paid application has been approved. |
| Airline and landing | Passport, ticket, onward or return evidence where applicable, funds, accommodation, and evidence matching the real purpose of travel. | That CBC must admit the traveller or remove every landing condition. |
Separate visitor landing from permission to work
Visa-free visitor status and permission to land do not authorise ordinary employment. Cayman work-permit rules and forms have changed over time, including 2026 amendments. Plan the employer, application, medical, police, travel, and start-date sequence from the current WORC route rather than an old checklist.
- Ask the employer which WORC route applies, who owns the application, which evidence is outstanding, and what written milestone permits the specific person to perform the specific work.
- Keep the offer, application reference, receipts, correspondence, medical and police evidence, decision, passport endorsement or digital status, and employer start-date confirmation.
- Do not start orientation, remote work from Cayman, client delivery, or another activity that may count as work until the employer and relevant authority have confirmed the position.
- Treat each dependant's landing, permission, insurance, school, and later employment position as a separate file.
Close Spanish employment as a reconciliation
Before departure, reconcile the written end date, contract and amendments, final payroll, unused leave, bonus or commission, expenses, benefits, company property, contribution records, tax information, references, and the contacts needed for later corrections. The exact termination documents, amounts, deadlines, and rights depend on the employment facts and applicable law, so use the employer's written calculation and employment advice rather than a generic checklist as the legal answer.
- Resolve mismatched names, dates, NIF or NIE, Social Security number, salary bases, contributions, or bank details while the employer and Spanish phone number remain accessible.
- Do not sign an inaccurate or misunderstood settlement; obtain employment advice if the termination, calculation, or record is disputed.
- Budget from money actually received, not an estimated settlement, refund, benefit, pension payment, or exchange rate.
| Control | Ask the employer for | Keep yourself |
|---|---|---|
| Employment end | Written last day, termination basis, handover, leave, property return, benefit end dates, and the records applicable to the actual exit. | Contract, amendments, notices, time and leave records, role evidence, handover, and correspondence. |
| Money | Final payslip, salary, bonus or commission, leave, expenses, deductions, indemnities where applicable, and payment date. | Payslips, calculations, receipts, bank credits, contribution evidence, and disputed-item correspondence. |
| Future corrections | Payroll, tax, HR, benefits, and contribution contacts that remain available after departure. | Qualifications, references, annual payroll and tax records, protocol numbers, and secure contacts. |
Determine Spanish tax residence from the full evidence
AEAT's current guidance does not reduce the answer to a flight or one day count. Its domestic tests include more than 183 days in Spain, subject to the stated sporadic-absence rule, and the main core or base of activities or economic interests; family presumptions and treaty tie-breakers can also matter. Administrative residence is not the same as tax residence, and the position is assessed for the calendar year.
- Do not use citizenship, a work permit, Cayman lease, Model 030, or a simple 183-day slogan as the whole analysis.
- If the home, family, income, assets, company management, prior filings, or timing is mixed, obtain Spanish cross-border tax advice before taking or filing a residence position.
| Evidence lane | Control question | Keep |
|---|---|---|
| Days and homes | Where was each day spent, which sporadic absences matter, and what homes remained available? | Passports, tickets, travel calendar, leases or ownership, utilities, and household evidence. |
| Work and economic interests | Where were employment, management, professional activity, income, assets, and investments centred? | Contracts, payors, companies, property, accounts, investments, management records, and tax workpapers. |
| Competing residence position | Does another jurisdiction claim residence, is treaty analysis relevant, and what certificate or advice supports the position? | Tax-residence certificates, returns, advice, notices, supporting documents, and correspondence. |
Use the correct AEAT census and address-change lane
AEAT says Model 030 is used by individuals in its defined census lane, including certain changes to tax address and personal data. People who carry on business or professional activities or fall within other census obligations can have a different form and procedure. A foreign-address update records data; it does not by itself determine tax residence or close every filing.
- Use AEAT's current procedure and instructions for the actual taxpayer status; do not copy a Model 030 deadline or checkbox from someone else's move.
- Export returns, notices, balances, direct-debit details, certificates, powers of attorney, secure messages, and adviser workpapers before changing devices or phone numbers.
| Question | Confirm before filing | Evidence to retain |
|---|---|---|
| Which census lane? | Individual outside the business or professional census, autónomo, company representative, withholding obligor, or another status? | Current procedure, form, adviser note, NIF or NIE, filed copy, and acknowledgement. |
| Which address and date? | Tax address, notification address, effective facts, submission deadline, and whether an earlier return deadline applies. | Lease or residence evidence, travel calendar, address proof, filing receipt, and portal confirmation. |
| Residence-status evidence | What foreign tax-authority certificate, identity evidence, translation, or other support does the live procedure request? | Certificate, identity document, translation, submission, request for information, and decision. |
Treat Model 247 as a narrow employed-worker procedure
AEAT's Model 247 route is for an employed worker expected to become an IRNR taxpayer because an employer sends the worker abroad. The resulting certificate can affect payroll withholding for the period described by the official procedure, but AEAT expressly says it does not exempt the worker from later proving the new tax residence. A resignation, independent move, founder relocation, or contractor case is not automatically the same lane.
- Ask whether the employer is sending the employee abroad, whether the expected non-resident facts satisfy the procedure, who submits the communication, and which evidence supports the departure and duration.
- Keep the employer letter, Model 247, attachments, AEAT certificate, payroll instructions, payslips, later residence evidence, and any correction.
- Do not use the certificate as proof that Cayman has accepted the person, that Spanish residence has conclusively ended, or that no Spanish return or withholding issue remains.
- If Model 247 does not fit, record the actual payroll, withholding, residence, and filing route instead of forcing the move into it.
Map retained Spanish income, property, pensions, and entities
A move can leave Spanish rent, a home, salary or deferred pay, a pension, shares, an autónomo activity, a company, professional fees, investments, loans, an estate, a refund, or another filing behind. Residence status is only one part of the file; retained Spanish-source items, entities, registrations, payors, and assets may continue to create reporting, withholding, management, or payment obligations.
- Inventory each property, entity, directorship, shareholding, investment, pension, loan, account, contract, tenant, payor, administrator, registration, and expected transaction.
- Assign the return, withholding, company filing, property management, bank, representative, power-of-attorney, and evidence owner for every retained item.
- Confirm how a change in residence affects each payor or institution, then retain the instruction, certificate, statements, returns, and resulting withholding.
- Do not sell, gift, dissolve, transfer, surrender, deregister, or appoint a representative merely to simplify the move; record the commercial, legal, tax, and control decision first.
Put overseas pension controls on an annual calendar
Spanish Social Security says pensioners resident abroad must communicate specified changes and provide proof of life within the first calendar quarter each year to continue receiving the pension and avoid suspension. That is a control for a pension already in payment; it does not determine tax treatment, currency costs, beneficiary rules, or whether another benefit is exportable.
- Confirm the managing INSS office, recorded residence and bank, payment currency and fees, tax position, portal access, contact route, and the accepted proof-of-life method for the current year.
- Calendar the first-quarter deadline and keep the competent-authority certificate, submission receipt, status, payment statements, and any follow-up.
- Report address, work, economic, or family changes when the official pension rules require it; do not rely on a bank update alone.
- Keep active-worker contribution questions separate from pension-payment and residence-tested-benefit questions.
Replace Spanish and European health assumptions with active cover
Spain's Social Security states that the European Health Insurance Card covers necessary care during temporary stays in the EU, EEA, Switzerland, and the United Kingdom, and is not valid when moving residence even within that framework. Cayman is outside that country list. A Spanish health card, TSE, employer promise, travel policy, or pending work permit is not active Cayman health insurance.
- Carry medical summaries, prescriptions, medication supply, results, imaging, immunisation and dental records, and emergency contacts outside shipped luggage.
- Build an explicit written bridge between the last dependable cover and confirmed Cayman policy activation.
| Stage | Evidence to obtain | Do not assume |
|---|---|---|
| Spanish position | Actual entitlement, end or change date, dependants, treatment in progress, records, prescriptions, and any formal overseas route. | A Spanish card or TSE covers relocation or routine care in Cayman. |
| Gap period | Written temporary cover, dates, territorial scope, pre-existing-condition terms, medication, evacuation, and claims route. | Travel insurance automatically covers employment, relocation, dependants, or routine care. |
| Cayman policy | Insurer, plan, member details, effective date, premium split, dependants, exclusions, deductible, network, overseas care, and claims access. | The offer, permit submission, or first deduction means every family member is enrolled. |
Order the Spanish criminal-record certificate for a named recipient
Spain's Ministry of Justice says the criminal-record certificate reports whether entries exist in the central convicted-person register at the issue date. It is not the same as the sexual-offences certificate and should not be treated as universal proof for every purpose. The Cayman recipient controls which jurisdictions, document type, issue age, format, translation, authentication, and delivery route are acceptable.
- Ask CBC, WORC, the employer, regulator, school, or other recipient for the exact issuing body, residence periods, age threshold, issue-date window, original or electronic format, apostille, translation, and delivery route.
- Confirm whether records from passport countries or other prior residences are required in addition to the Spanish certificate.
- Match names, prior names, birth data, identity numbers, passport, address history, and recipient instructions before submitting.
- Keep the application, fee, identity evidence, certificate, verification data, apostille, translation, courier chain, and recipient acceptance together.
Sequence civil records, apostille, translation, and acceptance
Spain's Justice portal provides online routes for birth certificates and other civil or justice records, while the Hague apostille authenticates the signature or seal and the capacity of the signer on eligible public documents. It does not certify the truth of the content, replace a required translation, make a stale document current, or guarantee that the Cayman recipient accepts that version.
- Keep the original or verified electronic record, apostille, translation, certified copies, verification codes, receipts, courier tracking, and acceptance evidence as one chain.
- Never mail the only original until the destination, return route, tracking, replacement route, and recipient custody have been confirmed.
| Step | Control | Do not assume |
|---|---|---|
| Recipient instruction | Exact record, full or extract version, issuing office, acceptable age, original or electronic form, apostille, translation, copies, and delivery. | A general moving checklist controls the recipient's file. |
| Spanish issue | Correct registry, identity method, purpose, names and annotations, issue route, secure verification code, and delivery time. | Every certificate is issued instantly or in the same format. |
| Authentication and translation | Whether the document is eligible for electronic or other apostille, competent authority, translator requirements, name consistency, and recipient verification. | Every document needs an apostille or every apostille guarantees acceptance. |
Protect passport, consular, and Spanish digital continuity
The Consulate General of Spain in London's current demarcation page lists an honorary consulate in the Cayman Islands. An honorary office may not provide every passport, civil-registry, notarial, or emergency service. Confirm the competent office, appointment, service location, travel requirement, document list, fee, and emergency route before relying on a renewal or civil service.
- Check every traveller's passport validity, blank pages, name and birth data, prior passports, transit route, Cayman status evidence, and future travel calendar.
- Ask which services the Cayman honorary consulate can perform, which remain with the Consulate General in London or another office, and whether travel, mail, or online steps are required.
- Keep Cl@ve, digital certificate, AEAT, Social Security, bank, email, authenticator, Spanish SIM, device, and account-recovery paths working through the handoff.
- Store secure colour scans, application references, emergency contacts, and replacement instructions separately from originals and shipped luggage.
Redesign banking and source-of-funds evidence
A change in tax residence, address, phone, employment, and expected transactions can affect Spanish account operation and compliance review. There is no safe universal assumption that every bank, investment platform, pension product, loan, insurance policy, payment product, or digital service stays unchanged for a Cayman resident. Ask each institution about the actual product before moving money or access.
- Keep enough overlap to receive final payroll, settle bills, pay Spanish obligations, and answer compliance questions without relying on one card, phone number, or authenticator.
- Do not structure transfers to avoid reporting or review; preserve the lawful source, purpose, counterparties, conversion, fees, and end-to-end bank trail.
| Control | Confirm | Evidence to keep |
|---|---|---|
| Spanish accounts | Residence and address update, product eligibility, cards, transfers, investments, loans, fees, tax forms, statements, beneficiaries, and closure route. | Written institution instructions, updated profile, statements, balances, beneficiaries, and closure or continuation evidence. |
| Digital access | Spanish SIM, email, authenticator, app, device, Cl@ve, digital certificate, AEAT, Social Security, recovery, and authorised representative. | Test log, recovery codes, device list, protocol numbers, authority records, and secure emergency route. |
| Cayman onboarding | Employer letter, passport, permit or status, address, tax self-certification, bank reference, source of funds, and expected activity. | Employment and identity records, statements, sale or final-pay evidence, tax documents, transfer trail, and certified copies where requested. |
Gate housing and school commitments behind the real move
The strongest sequence is evidence first, temporary landing second, and a long-term commitment only after work permission, insurance, commute, school, and cash files line up. A Cayman lease, purchase reservation, or school application should not manufacture confidence in an unresolved immigration or employment timetable.
- Shortlist neighborhoods from the actual work location, school route, peak-hour commute, budget, flood and storm questions, transport, household needs, and likely start date.
- Ask landlords or agents for the full deposit, rent, utility, maintenance, inventory, insurance, pet, break, renewal, notice, and payment terms before transferring money.
- Ask schools for current space, curriculum, age placement, assessment, records, immunisation, support, fees, deposit, refund, transport, and immigration requirements in writing.
- Keep a cash reserve for temporary accommodation, transport, permit timing, insurance gaps, school timing, shipment delay, deposits, and bank-onboarding friction.
Control shipping, customs, and the arrival sequence
Cayman Customs & Border Control publishes the official imports route. A shipper's quote does not prove duty treatment, eligibility, valuation, prohibited or restricted status, inspection, clearance, storage, or delivery timing. Build the inventory and evidence before packing, then align shipment with the real housing and immigration dates.
- Create a photographed inventory with ownership date, value basis, serial numbers, receipts where available, and a carry, ship, store, sell, donate, or exclude decision.
- Ask CBC or a licensed broker about the actual traveller, status, goods, relief if any, forms, valuation, restricted items, medicines, food, plants, alcohol, vehicles, fees, and inspection route.
- Keep passports, permit records, civil and police documents, Spanish tax and bank access, medication, school records, valuables, and first-month essentials out of checked or shipped household goods.
- Write the arrival-day handoff: airport evidence, temporary address, transport, employer contact, insurance proof, emergency cash, communications, keys, and a fallback if landing or baggage does not go to plan.
Run the first 90 days as a reconciliation
Arrival does not close the Spanish file. Reconcile permission to work, employer onboarding, insurance, first payroll, Cayman bank, housing, school, shipment, Spanish tax calendar, census updates, retained income and assets, Social Security and pension controls, bank classification, digital access, and consular records against the evidence pack.
- Days 1–10: confirm landing conditions, written work-authorisation milestone, employer records, insurance, phone, transport, emergency cash, and temporary-address evidence.
- Days 11–30: reconcile first payroll, deductions, insurance details, bank onboarding, lease evidence, school handoffs, shipment status, and Spanish account access.
- Days 31–60: review Spanish tax-residence evidence, AEAT census and filing calendar, retained income and assets, payor and bank instructions, pension issues, and open employer or contribution corrections.
- Days 61–90: archive receipts, close resolved controls, test recovery paths, update consular records, representatives and beneficiaries, and calendar every remaining Spanish and Cayman deadline.
Know where professional advice is essential
This page is a planning guide, not a Spanish tax-residence conclusion, AEAT form instruction, employment calculation, Social Security or pension determination, bank eligibility decision, apostille instruction for a specific document, Cayman work-permit or landing outcome, financial recommendation, or legal opinion. Use the official sources below to frame the file, then have the relevant authority or qualified professional confirm material decisions in writing.
- Spanish cross-border tax and business: residence, census lane, returns, retained income and property, entities, management, investments, pensions, withholding, representatives, and continuing filings.
- Spanish employment and Social Security: contract close, final money and records, autónomo or employer deregistration, contribution history, corrections, pensions, benefits, and representation.
- Cayman immigration and employment: visitor entry, transit, landing, work-permit route, permission to work, dependants, medical and police evidence, start date, job changes, and renewals.
- Banking, insurance, property, school, custody, consent, powers of attorney, translations, apostille, and regulated transfers where the receiving institution's exact requirements control.
