Short answer: preserve the live AF42 and reconcile it with current Part 2C
Download AF42 from the live WORC Immigration Forms inventory on the filing date, preserve the exact PDF and hash, and compare every answer with section 42, Schedule 5 Part 2C, the certificate, the R42 application and supporting file, the prior declaration, current fee materials, and written WORC instructions. The live form says filing is between 1 and 31 December, or when the prescribed annual fee is paid on the anniversary of a granted right to work. It directs the holder to send the declaration with proof of CI$500 payment to AnnualDeclarationSubmissions@gov.ky. WORC's 7 August 2026 reminder also identifies this certificate category and allows email or Apollo House West submission. Confirm the exact route before signing or paying.

Record the live version before answering anything
The live Annual Declarations tab selected a URL ending 2026-06-003f, while the one-page PDF is internally marked WORC/RPI DEC (2026/07) AF42. It contains eleven statements, lettered (a) through (k), and asks for a Cayman oath before a Justice of the Peace or Notary Public. Preserve the source exactly. The form also contains awkward agreement and alternative wording, including 'have suffered, and am not suffering', 'was not/were not authorised', and 'Neither my dependant(s) nor I am'. Do not silently rewrite a sworn source.
- Save the unedited live PDF and record its source page, link, download date, page count, internal code, filename signal, and SHA-256 hash.
- Treat every displayed paragraph from (a) through (k) as in scope and retain the form's definition of 'destitute person'.
- Do not repair grammar, combine alternatives, update statutory labels, or rewrite a declaration without current instructions.
- If WORC replaces AF42, compare every field, statement, footnote, instruction, oath, warning, payment and submission detail before carrying answers forward.
Build a live-form-to-current-law reconciliation
Current Schedule 5 Part 2C prescribes ten declarations, lettered (a) through (j), plus dependant particulars. The live AF42 instead presents eleven statements under a since-grant-or-last-declaration introduction and includes a separate sufficient-financial-resources statement. Part 2C uses different person scope and wording for convictions, insurance, communicable disease, mental health, dependant authorization, ordinary residence, and maintained investment. Prepare a line-by-line reconciliation and obtain written instructions on how omitted or differently worded particulars should be supplied.

Identity, certificate, prior declaration, and review periods
AF42 asks for the certificate name, date and country of birth, and certificate date, then frames its statements from grant or the last annual declaration, whichever is later. Part 2C separately measures ordinary residence from the certificate-issue date and requires the maintained application investment. Build one chronology that identifies the operative certificate, any work-right variation, prior AF42, dependant certificates, reported changes, and the exact period used for each declaration.
- Reconcile the certificate name with passport and any legal-name change record.
- Record certificate number, issue date, conditions, qualifying investment, dependants, and every variation.
- Retain the R42 application and investment file, prior declaration, payment and delivery proof, responses, and later corrections.
- Do not use one blanket review period where the live form and current Part 2C use different anchors.
Maintain the developed-real-estate investment evidence file
Part 2C asks the section 42 holder to declare that the investment level made at application continues to be maintained, including at least two million Cayman Islands dollars in developed real estate in Cayman. The live AF42 compresses this to an investment of at least CI$ 2,000,000. Reconstruct the approved application position and every later title, financing, transfer, valuation, development, damage, insurance, or ownership event. This page does not value property or decide what amount, ownership, financing, paid-up position, or asset change satisfies the certificate.

Build the ordinary-residence chronology from certificate issue
Current Part 2C asks whether the holder has been ordinarily resident outside Cayman for a continuous period of one year or more since the certificate was issued. The live form places its similar statement beneath a since-grant-or-last-declaration introduction. Those periods are not interchangeable. Build a complete residence and travel chronology from certificate issue, then separately identify the period covered by the current form. This page does not decide ordinary residence or how exceptional, medical, family, detention, work, or involuntary absences are treated.
- Create a dated Cayman and overseas address chronology tied to leases, title, utilities, employment or business records, and other primary evidence.
- Reconcile passports, itineraries, boarding passes, travel-account history, and available immigration records.
- Identify every continuous overseas interval and every fact relevant to where ordinary life was actually centered.
- Keep ordinary residence separate from physical-presence day counts, tax residence, domicile, work permission, and immigration status in another country.
Prepare the current dependant and education schedule
Part 2C requires details for accompanying and non-accompanying dependants: name, birth date, nationality, relationship, country of residence, accompanying status, and whether the accompanying number changed. It also asks for school or educational-institution details and, for a dependant aged eighteen or older, whether the person is in full-time tertiary education. The live AF42 has none of those fields. Confirm the accepted schedule and the relevant variation form before submission.
- Build one row per dependant and reconcile it to passport, civil records, certificate, insurance, address, and school records.
- Record every addition, removal, age or education change, date, notification, application, delivery proof, and written response.
- Minimize child, school, medical, financial, and immigration data and transmit it only through a confirmed channel.
- Do not infer dependant approval, continued residence, work rights, or variation acceptance from inclusion in a schedule.
Review convictions, health, and other sensitive declarations exactly
The live AF42 and current Part 2C differ on traffic-offence treatment, whether convictions and health declarations address the holder or dependants, communicable-disease certification, mental-health terminology, and the exact approved-dependant certificate. Current Part 2C uses Mental Health Act (2023 Revision) language. Read both sources exactly, preserve primary records, minimize access, avoid diagnosis or stigma, and obtain legal advice where meaning or disclosure is uncertain.
- Do not paraphrase conviction, public-funds, communicable-disease, prostitution-related, political/racism, mental-health, or dependant wording from memory.
- Separate the factual record from its legal classification and from the question of what must accompany the declaration.
- Do not assume the live form's traffic-offence exception or dependant scope overrides the current prescribed particulars.
- Do not use this checklist to diagnose a person, assess capacity, label a condition, or predict immigration consequences.
Written explanation, Cayman oath, payment, submission, and closeout
The live AF42 says a holder unable to make any of its eleven statements without making a false statement must provide an explanation to the Director of WORC in writing without delay. Part 2C says a written explanation must be included in the declaration where a prescribed declaration cannot truthfully be made. Stop before signature, prepare a factual chronology and evidence index, and obtain instructions on wording, timing, and delivery. The live form provides for the oath in Cayman before a Justice of the Peace or Notary Public, with the officer's name, signature, and seal.
- Do not omit a current Part 2C particular because it is absent from the one-page form or leave a known conflict for correction after oath.
- Confirm whether an explanation belongs in, with, and/or separately before the declaration and how receipt will be proved.
- Retain the exact signed and sworn AF42, reconciliation or schedule, explanation, payment proof, attachment index, sent email or office receipt, and immutable copy.
- Treat false-statement, offence, penalty, and revocation wording as reasons for careful review, not as a prediction that every error produces a particular consequence.
- Calendar the next declaration and earlier investment, property, residence, insurance, dependant, education, and work-right controls.
